We draft and review the full range of Islamic financial contracts including all types of Sukuk, capital market instruments, hedging contracts, banking and finance documents, Takaful insurance policies, Islamic fund documents and equity and partnership agreements. When we review existing client documents, our comments may require them to re-draft certain provisions, delete certain provisions and/or incorporate new provisions to render them Shariah compliant. We flag up issues based on our expertise in Shariah law and we also apply our knowledge of English law and our experience in reviewing similar documentation to advise on how any provisions can be amended to reconcile them with Shariah law.

We have expertise in the laws and business customs and cultures of the countries of the Arabian Gulf including Saudi Arabia, UAE, Bahrain, Qatar, Oman and Kuwait and have experience in working closely with local lawyers in other Muslim jurisdictions. We have in-house capabilities in Arabic, Urdu, Pashto and Punjabi.

  • Shariah Advisory Boards, Shariah opinions and Shariah audits

We regularly set up and act as the Shariah Advisory Board for a range of clients. Our role as the Shariah Advisory Board is in essence two-fold. Internally we work with the client to help them make their business and activities Shariah compliant and externally, we provide comfort and credibility to customers, investors and other third parties.

We provide Shariah Opinions on the Shariah compliance of financing and funding arrangements confirming that they are compliant with practices that are generally prevalent and approved by Shariah Advisory Boards in the Islamic finance industry. We review corporate and constitutional documents, policies and contracts and provide formal written opinions to confirm the Shariah compliance of the business of our clients.

We conduct annual and interim Shariah audits and provide ongoing Shariah certification.
